Surely Richard Posner cannot be serious. In a post at The Economist’s Free Exchange blog Posner is quoted as suggesting that copyright holders should be able to forbid linking. This appears to be an attempt to preserve the existing ‘dead tree press’ business model.
Surely the learned Mr Posner jests?
This is failure to recognize the impact of a disruptive technology and is akin to the law in the UK when motor cars first arrived, requiring a man to walk in front with a flag.
